EXCLUSIVE: Highlights from Tina Peters’ Oct 16 Hearing – Is Judge Varholak Considering Sending Her Home?


Based on highlights below from Tina Peters’ hearing in Colorado yesterday, is Judge Varholak hinting at sending Tina home?

Tina Peters’ case was an effort to portray her as a terrible criminal.  This was not true.  Tina had never been arrested before and was doing her job as the Mesa County Clerk in early 2021 by saving records of a recent election according to the law.

But when Tine reported on anomalies and differences identified in results before and after an election system upgrade in her county, all hell broke loose.  Tina was vilified and shamed and indicted, arrested, and imprisoned. 

In her trial, the judge (Judge Barrett) made flawed statements in his efforts to imprison Peters.  He shared:

“You are a charlatan and you cannot help but lie as easy as it is for you to breathe. You betrayed your oath for no one other than you.  And this is what makes Mrs. Peters such a danger to our community.  It’s the position she held that has provided her the pulpit from which she can preach these lies, the undermining of our democratic process, the undermining of the belief and confidence in our election systems.

So the damage that is caused and continues to be caused is just as bad, if not worse, than the physical violence that this court sees on an all too regular basis. And it’s particularly damaging when those words come from someone who holds a position of influence like you. Every effort to undermine the integrity of our elections and the public’s trust in our institutions has been made by you. You’ve done it from that lectern. The voting public provided you with everything you’ve done has been to retain control influence. The damage is immeasurable. And every time it gets refuted, every time it’s shown to be false, just another tale is weaved.”

These comments showed the bias coming from the judge.  He was after the gold star mother and courageous woman who was just doing her job.

In a fair debate, we could easily pick apart ALL the statements above from Judge Barrett as being LIES based upon unfounded assumptions.  This all leads to the court hearing yesterday in Colorado.

This was Judge Varholak’s court.  He appeared very focused during her hearing on whether or not Tina’s speech was dangerous enough induce violence.

Judge Barrett claimed that her speech was “just as bad, if not worse than the physical violence his court sees on an all too regular basis”, yet he offered ZERO substantiation for that claim.  Additionally, history has shown that ZERO violence EVER resulted from the information put forth from Tina Peters.  Her entire history is all contained on her website https://tinapeters.us/.

Too bad for the prosecution that Tina’s disclosures occurred after Jan 6, 2021, because they would have likely blamed that violence on her (which the Deep State orchestrated via paid provocateurs–but that’s a whole other story).  There’s NOTHING in any way, shape of form that resembles ANY type of violent response.

While Judge Varholak didn’t allow the Venezuelan Testimony from the actual programmers who claimed to write the software to cheat in our elections as a result of yesterday’s hearing, ironically at the same time MORE VENEZUELAN ELECTION MACHINE MALFEASANCE WAS JUST EXPOSED.

So, it looks like that perhaps within a week we will hear his ruling on whether Tina Peters was wrongly incarcerated for exercising her right to free speech.  Also, keep in mind, one’s exercise of free speech doesn’t depend upon whether the person exercising that right is telling the truth or not.  If it did, practically all MSM would be in serious trouble.

ALL that matters is whether or not free speech is dangerous in the form of fomenting physical violence/yelling fire in a theatre etc.  It will be interesting to see whether anything can be pulled out of a hat to claim that Tina did incite violence/yelled fire in a theatre.

We will see if Judge Varholak sees Tina as the same risk that Judge Barrett claimed to see.  This is what is on the table. 

There were indications that Judge Varholak may see things differently than Judge Barrett.  If not, justice will be delayed and a good fearless woman will stay in prison for doing her job as Mesa County Clerk.
